PRIVACY POLICY

Scope of application. BARCELONACTUA undertakes to protect the privacy of its donors and users who access the website www.barcelonactua.org (hereinafter, the “Website”). The content of the website is owned, operated, licensed or controlled by BARCELONACTUA.

Anyone who browses this website becomes a user (hereinafter the “User”) of this Website.
The User can browse and use the Website without having to provide any personal data. The only personal data to which www.barcelonactua.org shall have access is data that is voluntarily provided by the User via email through the forms provided for this purpose or when contacting hola@barcelonactua.org via email or by any other means provided for on the Website. If personal data is collected through cookies, the User shall be duly informed by means of the Cookies Policy and the channels required by current legislation.


This document presents our policy on the compliance and use of personal data collected through our Website or auxiliary devices such as mobile phones and tablets. Use of the Website implies that the User accepts the provisions contained in this Privacy Policy and agrees to their personal data being processed in accordance with said Policy. Please note that, although the Website may contain links to other websites, this Privacy Policy applies to the Website alone and not to the websites of other companies or organisations to which the User might be redirected from the Website. BARCELONACTUA does not control or approve the content of third-party websites or accept any liability for the content or privacy policies of said websites.
Protection of personal data. In light of the above, and in compliance with the provisions of Regulation (EU) 2016/679 of the European Parliament and the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, as well as the provisions of the regulations in force, we shall now proceed to provide complete information on the points indicated below:


1. Data controller. BarcelonActua Foundation (hereinafter, “BARCELONACTUA”), of Spanish nationality, with tax code (CIF) G66571746 and registered office at Carrer de Santa Perpètua, 6-8, 08012 Barcelona, listed with the Catalan government’s Registry of Foundations under No. 2943, and in accordance with the provisions of Law 4/2008 of 24 April, hereby informs Users who access or use the services, applications, tools and, in general, content included in www.barcelonactua.org (hereinafter, the “Social Network”) of the conditions that apply to accessing and browsing said Social Network.


2. Data processed, record of processing activities and purpose of these activities. With regard to the processing of the personal data provided to us, or any other data that might arise as a result of executing the services requested from us, Users are informed that said data shall be incorporated into the current data processing system, whose ownership and responsibility lie with BARCELONACTUA, and that they expressly consent to the processing of said personal data in a lawful, fair, transparent, appropriate, relevant, limited, accurate and updated manner to facilitate access to the content and applications of the Social Network, manage the services requested, allow information to be exchanged with other users, manage their donations, improve our services and adapt them to user profiles, as well as to keep them informed about updates on the Social Network and any other information that may be of interest to them concerning the Social Network.



The User also expressly consents to receiving electronic communications with news from BARCELONACTUA on the events and activities it carries out.


Notwithstanding the foregoing, and in accordance with the provisions of the GDPR, all email addresses provided by unregistered Users shall be treated by BARCELONACTUA with the utmost confidentiality and shall be used exclusively to send emails inviting said Users to register on the Website and shall therefore not be incorporated into the records owned by BARCELONACTUA until such time as said Users provide their consent.


The User provides the following data for such purposes: Name, Surname(s), Gender, District and Email.
The email address provided by the User may be used by BARCELONACTUA to contact them in the event of problems with completing purchases and shall be stored to recognise the User when they return to the Website, for the purposes of improving their experience.


3. Retention period for personal data. Data shall be retained for the time necessary to comply with legal obligations.
In case of subscribing to email newsletters, it shall be retained until such time as the User unsubscribes.
The information collected by our cookies shall also be retained for a maximum period of 24 months.


4. Legal basis for the processing of personal data. The processing of personal data is based on the informed consent obtained in accordance with the provisions of the legislation when the User ticks the checkbox required to access the Website, as well as in the contractual and/or pre-contractual relationship that binds BARCELONACTUA and the User.


5. Transfer of personal data. The information relating to our customers is a fundamental part of our business and we do not participate in the business of selling said information to third parties. It shall be transferred only to providers so that they can provide us with contracted services, in particular to the IT company One Tech Team and all professionals required to fulfil the services provided.


6. Rights of the User. Users may exercise their rights of access, rectification, erasure, objection and restriction of processing, and the right not to be subject to individual decision-making, by sending a written and signed request, including their name, their surname(s) and a photocopy of their ID card or another valid supporting document, to BARCELONACTUA at the address provided above or the email address hola@barcelonactua.org.
In light of the nature of the services provided, the right of portability shall not apply.
Exercising these rights is free of charge, unless unfounded or excessive requests are made, in which case the User shall bear the cost of processing the request.
Users may also submit any complaints they deem appropriate to the competent supervisory authority.


7. Data collection through devices such as mobile phones and tablets. When the User downloads or uses applications created by BARCELONACTUA and requests or consents to location services, as applicable, we may receive information about their location and their mobile device or tablet, including a unique device identifier. We may use this information to provide the User with location-based services, such as search results and other personalised content.
Most mobile devices allow such location services to be disabled.


Confidentiality

In compliance with current regulations, BARCELONACTUA Foundation undertakes to comply with its obligation of secrecy concerning the personal data provided by the User while browsing this Website and its duty to keep said data confidential. However, BARCELONACTUA cannot guarantee that unauthorised third parties shall not have knowledge of the characteristics and circumstances concerning usage of the Social Network by Users. BARCELONACTUA shall act diligently, in accordance with generally accepted uses in the sector, to prevent the presence on the Social Network of viruses or other harmful elements that may alter the User’s computer system, electronic documents or files, but we cannot guarantee the absence of such elements and shall therefore be held harmless from any liability for any damage these could cause.

Intellectual and/or industrial property rights

The User acknowledges that all elements of the Social Network, the videos, photographs, information and materials contained therein, the trademarks, structure, selection, layout and features of its content, and the computer programs used in relation thereto are protected by the intellectual and industrial property rights of BARCELONACTUA or third parties, and that use of the Social Network does not imply any rights with respect to industrial and intellectual property other than those that are specifically contemplated in the Social Network.
Unless authorised by BARCELONACTUA or, where applicable, by the third parties that hold the corresponding rights, or unless it is legally permitted, the User may not reproduce, transform, modify, disassemble, reverse engineer, distribute, rent, lend, make available or allow the public to access, through any form of public communication, any of the elements referred to in the foregoing paragraph. Users may use the materials, elements and information they access when browsing and using the Social Network solely for their own needs, and agree not to carry out, directly or indirectly, commercial exploitation of the materials, elements and information obtained through the Social Network.
Users must refrain from deleting the symbols indicating the rights (whether intellectual, industrial or any other rights) of BARCELONACTUA or third parties that appear on the Social Network, as well as from avoiding or manipulating any technical devices established by BARCELONACTUA or third parties on the Social Network.
Under no circumstances shall it be deemed that any licence has been granted or that any waiver, transfer or total or partial assignment of the aforementioned rights has been carried out, or that any right or expectation of right has been conferred, especially with respect to alteration, exploitation, reproduction, distribution or public communication over said content without the prior express authorisation of BARCELONACTUA or the corresponding owners.

Notices and revisions

If a User has a question regarding the privacy of http://www.barcelonactua.org/, they may send us an email detailing the query and we will endeavour to answer it.
BARCELONACTUA Foundation may modify and update this Privacy Policy at any time without prior notice. Users must ensure that they are always aware of our Privacy Policy and the terms and conditions of use so that they remain informed at all times of the content that is collected through the Website, how we use it and the circumstances under which it may be disclosed to third parties. Users shall be automatically bound by the conditions of use that are in force at the time they access the Website, so they are required to read this document periodically.

Subscribing to the newsletter: in the event that a User subscribes to the BARCELONACTUA newsletter, we shall provide them with information about our events, through various means, including (but not limited to) email, any other equivalent electronic means of communication such as SMS, and telephone calls.

SOCIAL NETWORKS

USE OF THE SOCIAL NETWORK

BARCELONACTUA may, at any time and without prior notice, modify the presentation and configuration of the Social Network, as well as the conditions required for its use. These modifications shall be published on the Social Network so that the User is aware of them before using the Social Network. Use of the Social Network after the conditions of use have been modified shall imply that the User accepts the modified conditions. However, BARCELONACTUA reserves the right to modify, develop or update these conditions of use at any time and without prior notice.



USERS OF THE SOCIAL NETWORK

1.    By using the Social Network, the User states and guarantees that they are of legal age. To use the Social Network, minors must obtain prior permission from their parents, guardians or legal representatives, who shall be held responsible for all acts carried out by the minors in their care.
2.    BARCELONACTUA may, at any time and without prior notice, deny or withdraw access to the Social Network for Users who contravene the provisions of these conditions of use, the law, customs or public order.
3.    Access to the Social Network is open and free of charge. To access certain content and applications of the BARCELONACTUA Social Network, the User shall be required to register on the Social Network. The data obtained through this procedure shall be subject to the Privacy Policy set out in these general conditions. The registration procedure shall be detailed at all times in the corresponding section of the Social Network.
4.    The password that is chosen by the User when registering and is validated, where appropriate, by BARCELONACTUA, shall be considered as a tool for identification and access. The password shall be personal and non-transferable.
5.    The User shall be obliged to practise due diligence when storing their password. If not, they shall accept the consequences that may arise from its use by third parties other than the User and shall hold BARCELONACTUA harmless for any type of unauthorised use of the password.
6.    The User shall be responsible for all operations carried out with their password.
7.    The User undertakes to notify BARCELONACTUA immediately of any unauthorised use of their password, as well as any access by unauthorised third parties.
8.    However, BARCELONACTUA may contact the User to verify the data provided by them, and may unsubscribe a User if they have provided false data or if they have requested more than one account on the Social Network.
